Our clients are mainly companies that use our services by directly accessing the portal www.pbs.group or by integrating with our service using their own software applications (via API). Productive Business Solutions S.A. collects and processes personal data about you as an individual or as an entity in the following situations:
JOB APPLICANTS: when you apply for a job position;
CUSTOMERS – when you use our Services;

The personal data we collect about you through this means are your name, surname, contact information, information about your education, your previous work experience, location/place of residence, or any other information you choose to share with us when you submit your resume.

CUSTOMERS
We collect and process personal data about you if you use our Services, for example, if you contract a hosting service at Productive Business Solutions S.A. and become our Customer.
For this purpose, we will collect your account data, which means your personal data related to your relationship with Productive Business Solutions S.A., such as your name and/or contact information (email, phone number, address), and billing information (name, address, phone, and if applicable taxpayer registration number).
The collection and processing of this data are necessary for us to establish a business relationship with you or to fulfill our obligations arising from our existing business relationship with you.
SALES CONTACTS
We collect your personal data when you visit our website and register for information for a specific Service, when you request information through one of our salespersons about a particular Service, or contact us with a question or complaint. We may collect this information through our "Sales Contact" form on the web or through a ChatBot via networking events, LinkedIn contacts, or another form of communication.

This means that our Customers will provide us with contact details (such as name, email address, phone number, or other contact details) of their employees authorized by the Customer to access the Productive Business Solutions S.A. account of the Customer while using our service.
While using our Services, the Customer will share with us personal data of their end users, such as recipient and/or sender contact details (e.g., phone number, email address, billing, location).
If the Customer uses the PBS Portal, such Customer may input other personal data of their clients/suppliers/end users into the Portal www.pbs.group, for example: name, company, address, contact, products, services, routes, and any other custom attribute defined, imported, and controlled exclusively by the customer. The precise personal data provided to us are determined and controlled solely by the Customer.
We process such personal data on behalf of our Customers and only for the purpose of providing our Services to our Customers, in accordance with the General Terms and Conditions of Service.
This means that the Customer is the controller and Productive Business Solutions S.A. is the processor regarding such personal data.
In providing our Services, we will also receive and process certain data for the purpose of transmitting, distributing, or exchanging content of Customer communications, for example, data used to track and identify the origin and destination of a transaction (such as phone numbers or email addresses of individual data subjects,

data about device location generated in the context within the mobile app, and the date, time, duration, and type of transaction). With respect to this personal data, Productive Business Solutions S.A. is the controller, as we collect and process this data for billing purposes.

As we are a constantly growing company, we have a constant need for new and talented individuals who will be part of our team. In order to provide our Services, we use some subprocessors who assist in providing our Services or otherwise may have access to data stored on our platform, and we maintain an up-to-date list of them (Amazon Web service, Flexmontern).
We are a global company and may share your personal data with our affiliated companies to complete internal procedures in our offices worldwide and provide technical support.
We may offer technical support for our services by operating a 24/7 support model, which means that Productive Business Solutions S.A. will not transfer your personal data to another jurisdiction; sometimes, we will provide customer support from outside of Guatemala. Productive Business Solutions S.A. will always ensure that the transfer of personal data is in line with applicable data protection law.

We reach out to individuals on their smartphones through network operators as well as other global communication providers, especially like Play Store, Claro, Tigo, and WhatsApp.
• Third-party service providers to the extent strictly necessary for them to perform specific actions on our behalf. We may share personal information with our trusted and verified external service providers, for example, to enable them to process payments for us or prevent fraud.

While we provide our Services, unless otherwise agreed in writing with the Customer, we will ensure that the personal data we have collected are stored and processed in processing systems contracted by Productive Business Solutions S.A. currently located in Guatemala and different countries.

In accordance with current national regulations on the protection of personal data, you can access or delete your personal data, as well as exercise other rights to have control over how your personal data are collected, used, and shared.
Where permitted by applicable law or regulation, you have the right to:
• Access the personal data we process about you and know the origin of the data, the purposes of processing, and the period during which your personal data will be processed, who are the controllers and processors of your personal data and who can access them.
• Withdraw your consent at any time your personal data are processed according to your consent.
• Update or correct your personal data so that they are always accurate.
